This policy explains how Smart Capital Council, S.L. processes the personal data provided through this website, in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

2. What data we process
Only the data you provide in the forms:
- Membership application: full name, email, current role and boards you sit on, route of access and the member who refers you.
- Company submission: full name, email, company and website, stage and round size, current revenue or ARR, link to the deck and the member or investor who refers you.
We do not request special categories of data. If you include data of third parties (for example, the member who refers you or members of your team), you confirm that you are entitled to provide it.
3. Why we process it and on what legal basis

We do not make automated decisions or create profiles with your data, and we do not use it to send marketing communications.
4. Who has access to your data
Applications and company submissions are seen by the members of the investment committee and, in the case of companies, by the Club members to whom the opportunity is presented, under a duty of confidentiality. We do not share your data with third parties unless legally required.
We use providers that process data on our behalf as data processors:
- Formspree, Inc. (United States), for receiving the forms. Safeguard: European Commission standard contractual clauses.
- Vercel Inc. (United States), for hosting the website. Safeguard: participation in the EU-U.S. Data Privacy Framework.
- Microsoft (Microsoft Ireland Operations Limited and Microsoft Corporation), for email through Microsoft 365. Safeguard: participation in the EU-U.S. Data Privacy Framework and standard contractual clauses.
5. How long we keep it
We keep the data while we handle your application or company submission and for a maximum of 24 months after the last contact, unless you become a member of the Club, in which case the terms of your membership will apply. Afterwards, the data is blocked for the legal limitation periods and then deleted.
6. Your rights
You may exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent at any time, by writing to club@smartcapitalcouncil.es and stating the right you wish to exercise. Withdrawing consent does not affect the lawfulness of prior processing.
If you believe we have not processed your data correctly, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the supervisory authority of your country of residence in the EU.
7. Security
We apply appropriate technical and organisational measures to protect your data, such as encrypted connections (HTTPS) and restricted access to the submissions received.
8. Cookies
This website does not use first-party or third-party cookies for analytics, advertising or tracking, so no consent banner is shown. Fonts are hosted on our own server and are not loaded from third-party services. Our hosting provider may use strictly technical elements to deliver the service securely, which are exempt from consent under article 22.2 of the LSSI-CE.
If we add analytics tools or other non-essential cookies in the future, we will update this policy and ask for your consent before installing them.
9. Changes to this policy
We may update this policy to reflect changes in the law or in the website. The current version will always be published on this page, with its update date.
